Notice of Application to Expand an Industrial Landfill

The Kansas Department of Health and Environment (KDHE) has received an application to expand the Acme Foundry, Inc. industrial (foundry sand) landfill. The permit modification will increase that landfill’s site area from 10.93 acres to 31.81 acres and its permitted disposal area from 7.5 acres to 22.97 acres. The expansion’s effect will be to increase the site’s disposal capacity from about 196,900 cubic yards to about 712,600 cubic yards. The proposed landfill expansion would be constructed and operated in conformance with state solid waste regulations and accept only industrial waste as defined by Kansas statutes and generated by Acme Foundry, Inc. The proposed landfill expansion site is located on US-166 highway about 1¼ miles east of Coffeyville, Kansas in the west half of Section 32, in Township 34 South, Range 17 East in Montgomery County.

The Montgomery County Commissioners have previously certified that the landfill is consistent with the county’s solid waste management plan and local land use restrictions or zoning. KDHE has reviewed the application and found it to be in conformance with the state solid waste statutes and regulations.

KDHE is today providing public notice of the intent to approve the proposed landfill expansion. However, a final decision to approve the expansion has not been made, and KDHE will consider information gathered during the public comment period before making a final decision. A copy of the administrative record which includes the permit application, engineering drawings, draft permit, and other information with respect to this permit action will be available for public review from January 13, 2022 through February 14, 2022, during normal business hours at the following locations:

Additionally, the permit application form with primary application information is available for public viewing at https://www.kdhe.ks.gov/168/Waste. Anyone wishing to comment on the landfill’s permit modification should submit written statements postmarked no later than February 14, 2022, to Charles Bowers at the Chanute address, by fax at 620-431-1211, or by email to charles.bowers@ks.gov. Mailed comments postmarked prior to February 14, 2022 and received within one week thereafter will also be considered.

After consideration of all written comments received during the public notice period, KDHE will make a final decision on whether to issue the permit. Notice of the decision will be given to the applicant, anyone who submitted written comments during the comment period, and those who requested notice of the final permit decision.
