Notice of Water Quality Certification

The Kansas Department of Health and Environment (KDHE) has drafted a water quality certification per Section 401 of the Clean Water Act (CWA) requested by the United States Army Corps of Engineers (USACE) per Public Notice No. RGP-40 2023 (2007-01915. See link below). The applicant proposes issuance of a conditional Section 404 Dredge and Fill Permit for the Renewal of GP-40 to authorize common Kansas agricultural soil and water conservation practices designed/approved by NRCS that have minimal adverse impact on aquatic resources for Kansas farmers, under provisions for work qualifying for federal funding, and concurrently provide the U.S. Department of Agriculture (USDA) efficiencies in execution of their Federally authorized soil and water conservation programs.

The draft conditional 401 certification and additional information containing the link to the USACE Public Notice will be posted on the KDHE website at https://www.kdhe.ks.gov/1095/Section-401-Water-Quality-Certification on or before January 12, 2023. Persons wishing to comment on the referenced draft document must submit their comments in writing by email to the Kansas Department of Health and Environment at KDHE.NPS@ks.gov by February 12, 2023, if they wish to have their comments considered in the formulation of final determinations for 401 regarding this public notice.
