Public Notice

The Kansas Department of Health and Environment (KDHE) has drafted a water quality certification per Section 401 of the Clean Water Act (CWA) requested by Holiday Sand and Gravel, for construction and operation of a facility in the flood plain of the Missouri River, Wyandotte County, Kansas. The development of an approximate 445-acre project site within the floodplain of the Missouri River. An approximate 300-acre pit would be excavated in five phases over a period of approximately 40 years. The work as proposed would permanently fill 18.08 acres of wetlands within the project site for the excavation of the dredging pit, sand processing plant, aggregate stockpiles, and related facilities. The work would also include the construction of a barge loading dock facility along the right descending bank of the river at approximate river mile 375.1.

The draft certification and additional information containing the link to the USACE Public Notice will be posted on the KDHE website at https://www.kdhe.ks.gov/1095/Section-401-Water-Quality-Certification on or before July 21, 2023. Persons wishing to comment on the referenced draft document must submit their comments in writing by email to the Kansas Department of Health and Environment at KDHE.NPS@ks.gov by August 22, 2023, if they wish to have their comments considered in the formulation of final determinations for 401 regarding this public notice.
