Notice of Hearing on Proposed Administrative Regulation

A public hearing will be conducted at 10:30 am Friday, December 8, 2023, at the Kansas State Board of Technical Professions, 900 SW Jackson, Suite 507, Topeka, KS 66612, to adopt amendments to K.A.R. 66-9-5 regarding the approved education curriculums for surveying as permitted by K.S.A. 74-7013 and 74-7022, and amendments thereto. It removes as approved curriculum for surveying the graduation from an approved engineering curriculum and the graduation from an approved four-year related science curriculum, which may include geology, mathematics, chemistry, or physics as approved educational requirements. It changes the date of the approved land survey curriculum, and it also removes approval of the requirement that the coursework in subsection (d) be from a school or college approved by the board.

This 60-day notice of the public hearing shall constitute a public comment period for the purpose of receiving written public comments on the proposed regulation. All interested parties may submit comments prior to the hearing to Larry G. Karns, Executive Director, at the Kansas State Board of Technical Professions above address, or via email to KSBTPadmin@ks.gov. All interested parties will be given a reasonable opportunity to present their views, orally or in writing, concerning the proposed regulation during the public hearing. To provide all parties with an opportunity to present their views, it may be necessary to request each participant to limit any oral presentations to ten minutes.

Copies of the proposed regulation as well as the economic impact statement for the proposed regulation may be obtained from the Kansas State Board of Technical Professions, 900 SW Jackson, Suite 507, Topeka, KS 66612, by contacting Larry G. Any individual with a disability may request accommodation to participate in the public hearing and may request the proposed regulation to be considered and the economic impact statement for the regulation in an accessible format. A summary of the proposed amended regulation and the economic impact of the regulation follows:

K.A.R. 66-9-5, as proposed, deletes the current subsection (a) “Graduation from an approved engineering curriculum as defined in K.A.R. 66-9-4” and deletes the current subsection (d) “graduation from an approved four-year related science curriculum, which may include geology, mathematics, chemistry, or physics” as approved education curriculums to fulfill the education requirements. The proposed regulation also removes the language in subsection (b) “from a school or college” and the language in subsection (d) “approved by the board.”

The proposed regulation is not anticipated to have any significant economic impact.
