Public Notice
The Kansas Department of Health and Environment (KDHE) has drafted a water quality certification per Section 401 of the Clean Water Act (CWA) requested by the United States Army Corps of Engineers (USACE) for an environmental assessment for chute repairs and flood damage modifications for the Benedictine chute located within the Missouri River in the vicinity of river mile (RM) 426-427 and the Dalbey chute located within the Missouri River at RM 416-419 both in Atchison County, Kansas. The Dalbey chute would use approximately 24,388 tons of stone fill repairing 1,000 feet of control structures. The Benedictine chute would use approximately 26,796 tons of stone fill and repair 2,838 feet of control structures. A finding of no significant impacts (FONSI) is resulting in the future completion of the project.
The draft conditional 401 certification and additional information containing the link to the USACE Public Notice will be posted on the KDHE website at https://www.kdhe.ks.gov/1095/Section-401-Water-Quality-Certification on or before August 4, 2023. Persons wishing to comment on the referenced draft document must submit their comments in writing by email to the Kansas Department of Health and Environment at KDHE.NPS@ks.gov by September 4, 2023, if they wish to have their comments considered in the formulation of final determinations for 401 regarding this public notice.
