Notice of Right to Request a Hearing Regarding the Proposed Revocation of Administrative Regulations

Pursuant to K.S.A. 77-440, the Kansas Department of Revenue, Division of Alcoholic Beverage Control (“ABC”) submitted a report to the Joint Committee on Administrative Rules and Regulations (“JCARR”) summarizing ABC’s review of its administrative regulations and identifying regulations that are not necessary for the implementation and administration of state law. Pursuant to K.S.A. 77-426(d), the Department of Revenue proposes to revoke 31 of the regulations identified in that report by filing a notice of revocation with the Secretary of State. Pursuant to K.S.A. 77-426(d)(2)(A), the Department will schedule a public hearing on the proposed notice of revocation only upon the written request of a member of the public. This Notice of Right to Request a Hearing serves as at least 30 days’ notice of the right to make that written request.

The following regulations are proposed for revocation because they duplicate existing statute, do not reflect current industry practices, or are inconsistent with statute.

  • K.A.R. 14-5-1. Alcoholic liquor (except beer) transported into state or federal area only by bonded carriers.
  • K.A.R. 14-5-2. Carriers’ permits; application; fees.
  • K.A.R. 14-5-4. Storage of alcoholic liquor and cereal malt beverage in transit in public liquor warehouses; reports of warehouseman.
  • K.A.R. 14-5-6. Required delivery of alcoholic liquor to distributor by common carrier.
  • K.A.R. 14-7-6. Kansas liquor stamps or strips; securing, affixation to original package; who shall affix; placing of stamps or strips.
  • K.A.R. 14-11-16. Farm wineries and farm winery outlets selling at retail; marking prices; price or inventory control tags; shelf markings.
  • K.A.R. 14-16-17. Hearing procedures; prehearing motions.
  • K.A.R. 14-16-18. Prehearing conference; availability; notice.
  • K.A.R. 14-16-19. Hearing procedures.
  • K.A.R. 14-17-5. Acceptance of hospitality by director and employees.
