Notice of Water Quality Certification

The Kansas Department of Health and Environment (KDHE) has drafted a water quality certification per Section 401 of the Clean Water Act (CWA) requested by Wildhorse River Works, Inc. representing Mr. John Fassnacht per Public Notice No. NWK-2023-674-675-676 Fassnacht Farms Streambank Rehabilitation projects - https://www.nwk.usace.army.mil/Media/Public-Notices/. The applicant proposes to rehabilitate three different sites totaling 3,405 feet of the eroding left descending streambank of the Delaware River located in Atchison County, Kansas. This project will require the placement of 3,978 tons of limestone rock and will be placed in the Delaware River to reduce erosion along the riverbanks. All disturbed areas will be seeded and mulched with native grasses, trees, and shrubs. It is estimated that 22 rock weirs or vanes and 1,260 feet of longitudinal peaked stone-toe protection (LPSTP) will be placed in the river and along the edge of water. Following placement of the structures, the eroding riverbank will be regraded to a three-foot horizontal to one-foot vertical slope and planted with a combination of native plant materials.

The draft certification and additional information containing the link to the USACE Public Notice will be posted on the KDHE website at https://www.kdhe.ks.gov/1095/Section-401-Water-Quality-Certification on or before December 7, 2023. Persons wishing to comment on the referenced draft document must submit their comments in writing by email to the Kansas Department of Health and Environment at KDHE.NPS@ks.gov by January 7, 2023, if they wish to have their comments considered in the formulation of final determinations for 401 regarding this public notice.
