111-4-3794. “Holiday Surprize” instant ticket lottery game number 428. (a) The Kansas lottery may conduct an instant winner lottery game entitled “Holiday Surprize.” The rules for this game are contained in K.A.R. 111-3-1 et seq. and 111-4-3794.

(b) The “prize symbols” and “captions” for this game are as follows:

(h) Approximately 1,800,000 tickets shall be ordered initially for this instant game. Additional ticket orders shall have the same prize structure, the same number of prizes per prize pool of 300,000 tickets, and the same odds as were contained in the initial ticket order.

(e) The price of instant tickets sold by a retailer for this game shall be $2.00 each.

(f) “Happy Holly Days” consists of two separate games. Game 1 is a slot style symbol match game. In the slot style game play area, there are five “ROWS” a player will scratch to reveal play symbols and a prize amount. Each “ROW” consists of three play symbols and a prize amount. If a player reveals three identical symbols in the same “ROW,” the player wins the prize amount shown for that “ROW.” If a player reveals two identical symbols and a symbol of a wreath in the same “ROW,” the player wins double the prize shown for that “ROW.”

Game 2 is a key number match game. The player will scratch the play area to reveal two “WINNING NUMBERS” and six “YOUR NUMBERS” with a prize amount below each of the “YOUR NUMBERS.” If a player matches any of the “YOUR NUMBERS” to any of the “WINNING NUMBERS,” the player wins the prize shown below that number. If the player reveals a symbol of a Christmas tree, the player automatically wins the prize amount shown below that symbol.

(g) Each ticket in this game may win up to 11 times.

(h) Approximately 1,200,000 tickets shall be ordered initially for this instant game. Additional ticket orders shall have the same prize structure, the same number of prizes per prize pool of 150,000 tickets, and the same odds as were contained in the initial ticket order.

(f) “Peppermint Payout Multiplier” is a number reveal game with a multiplier feature and four bonus spots. The main play area consists of seven different rows of peppermint-themed play spots covered with translucent material and a prize amount printed beside each row. The player will scratch the play area to reveal 22 “YOUR NUMBERS.” The player will then uncover each number in the main play area that matches any revealed “YOUR NUMBER.” If the player uncovers all the numbers in a single row, the player wins the prize amount shown for that row. The player will also scratch the multiplier feature. Each prize won in the main play area is multiplied by that amount. The player will also scratch the four bonus spots. If the player reveals a symbol of a present in any bonus spot, the player wins the amount shown in that bonus spot.

(f) “Gifts of Gold” is a key number match game with an instant win, three symbol match bonus areas and an additional symbol match play area on the back of the ticket. On the front of the ticket, the player will scratch the play area to reveal eight “WINNING NUMBERS” and 32 “YOUR NUMBERS” with a prize amount below each of the “YOUR NUMBERS.” If a player matches any of the “YOUR NUMBERS” to any of the “WINNING NUMBERS,” the player wins the prize shown below that number. If a player reveals a symbol of a stack of cash, the player instantly wins $100. The player will scratch the three bonus areas. If the player reveals two like symbols in the same bonus area, the player wins the prize amount shown in that bonus area. On the back of the ticket, the player will scratch the eight “ROWS” to reveal three play symbols and a prize symbol for each “ROW.” Each “ROW” plays separately. Article 19. —SPECIFIC PLAYER LOYALTY CLUB RULES

111-19-184. Winter Cash Bonus Drawings. (a) The Kansas Lottery may conduct promotional drawings for each of the five instant ticket games listed in subsection (b) entitled “Winter Cash Bonus Drawings” awarding cash prizes to players selected as winners. Entries into each drawing will be accepted beginning at 12:01 a.m. on the day the instant ticket associated with the drawing is first offered for sale to the general public and ending at 11:59 p.m. on February 2, 2025. The drawings will be conducted sometime after entry into the drawings has closed but before noon on February 6, 2025, at which time the winners will be announced.

(b) The specific tickets eligible for entry into these drawings shall be the following Kansas Lottery instant ticket games: $1 “Holiday Surprize” game number 428; $2 “Happy Holly Days” game number 429; $5 “Full of $500s” game number 430; $10 “Peppermint Payout Multiplier” game number 431; and $20 “Gifts of Gold” game number 432.

(c) A player shall enter the drawings through the Kansas Lottery PlayOn program available at www.kslottery.com. The player shall follow the hyperlink specifically designated for the purpose of accessing the “Winter Cash Bonus Drawings” promotion. The player may enter the required data from the entry ticket manually for entry into the drawings. If the player does not enter the ticket data manually, the player may scan, if available, the ticket to enter data to be used for entry into the drawings using a mobile device and a downloaded Kansas Lottery PlayOn app. After the ticket data is successfully entered either manually or scanned using the app, the player will receive one entry into the drawings based on the specific ticket.

(d) The procedures set forth in K.A.R. 111-18-5 for selecting winners and alternate winners shall be followed. The first entrant selected in each drawing shall be the winner of a cash prize.

(1) The first drawing conducted shall be from among the entrants in the $1 Holiday Surprize, game number 428, drawing. The cash prize awarded to the first entrant selected in the first drawing shall be $1,000.

(2) The second drawing conducted shall be from among the entrants in the $2 Happy Holly Days, game number 429, drawing. The cash prize awarded to the first entrant selected in the second drawing shall be $5,000.

(3) The third drawing conducted shall be from among the entrants in the $5 Full of $500s, game number 430, drawing. The cash prize awarded to the first entrant selected in the third drawing shall be $10,000.

(4) The fourth drawing conducted shall be from among the entrants in the $10 Peppermint Payout Multiplier, game number 431, drawing. The cash prize awarded to the first entrant selected in the fourth drawing shall be $15,000.

Article 22.—GENERIC eINSTANTS RULES

111-22-1. Definitions. (a) “Account” means a player’s account in the Kansas lottery’s player loyalty program defined in K.A.R. 111-18-1 et seq. and any credentials, email, login information, or password associated with that account.

(b) “Click” means to manually interact with an interactable graphical element through the use of a mouse, touchscreen, or other input device.

(c) “eInstant game” means an online instant lottery game in which a ticket is purchased by a player from the Kansas lottery and the player can determine if they win a prize by clicking on each part of the play area or a “reveal all” icon and comparing the revealed play symbols with those specified as winners in the published game rules for that online instant lottery game.

(d) “Executive director” means the executive director of the Kansas lottery, or the person designated by the executive director.

(e) “Expiration date” means the last date an eInstant game ticket may be validated and eligible to win a prize.

(f) “Lottery security” means the Kansas lottery security officer or a certified enforcement officer designated by the executive director or the person designated by the executive director.

(g) “Multi-ticket” means an eInstant lottery game in which more than one ticket of the same denomination may be purchased per game.

(h) “Play area” is the portion of the eInstant game where the play or game symbols appear.

(i) “Play symbols” are the numbers, letters, symbols, or pictures displayed in the play area of each eInstant game and which determine if the ticket purchaser is entitled to a prize according to the published game rules for that eInstant game.

(j) “Pool” or “prize pool” means a certain number of eInstant game tickets, such number determined by the published rules for that eInstant game, used to seed prizes randomly across the game to determine winning and non-winning tickets. The size of each pool shall be determined by the published rules for that eInstant game.

(k) “Serial number” means a unique number appearing on the front of each eInstant game which is used to identify and track the player’s purchase and which may be used to validate winning tickets.

(l) “Wallet” means an online service which tracks a player’s deposits, purchases, and prize payments. A player may make deposits, purchases, and withdrawals from the wallet according to the terms and conditions of the player loyalty program defined in K.A.R. 111-18-1 et seq. 111-22-2. Manner of selection of winners. Winners of an eInstant game are determined by the matching or specified alignment of the play symbols on a valid eInstant game ticket in accordance with the published rules for each eInstant game. (Authorized by and implementing K.S.A. 2023 Supp. 74-8710; effective, T-111-8-9-24, July 10, 2024.)

111-22-3. Deadline for claiming prizes. (a) A winning eInstant game ticket with a prize of $599 or less shall automatically be paid to a player’s wallet. A winning eInstant game ticket with a prize in excess of $599 shall not be paid until a player completes a claim form provided by the lottery as described in K.A.R. 111-22-8.

(b) All eInstant game tickets shall expire 180 days after purchase unless otherwise provided by the executive director. If a winner does not submit a claim form before a winning eInstant game ticket’s expiration date, the ticket shall be invalid and ineligible for any prize.

(c) For the purposes of this regulation, all tickets purchased concurrently within a multi-ticket eInstant game shall be considered a single eInstant game ticket. (Authorized by and implementing K.S.A. 2023 Supp. 74-8710; effective, T-111-8-9-24, July 10, 2024.)

111-22-4. Disclosure of winners. The city of residence of the winner of any claimed prize may be used in any lottery promotional campaign. (Authorized by K.S.A. 2023 Supp. 74-8710; implementing K.S.A. 2023 Supp. 74-8710 and K.S.A. 74-8720; effective, T-111-8-9-24, July 10, 2024.)

111-22-5. Ticket sales. (a) The sales price of any eInstant game ticket shall be $1.00 unless a different price is established by game rules adopted by the Kansas lottery commission for a specific eInstant game.

(b) eInstant game tickets shall be sold only by the lottery.

(c) eInstant game tickets shall not be sold to any person under the age of 18. The seller of any eInstant game ticket may require the purchaser to prove their age. (Authorized by K.S.A. 74-8710; implementing K.S.A. 2023 Supp. 74-8710 and K.S.A. 74-8718; effective, T-111-8-9-24, July 10, 2024.)

111-22-6. Determination of prize winners. (a) Each eInstant game ticket shall be drawn from a pool at the time of purchase.

(b) If the play symbols meet the requirements of the rules of the game, the player wins the prize designated by the rules of the game.

(c) Only play symbols and captions, if any, and serial numbers are used for determination of entitlement to prizes. Other numbers, symbols, icons, and the like, or any other portion of the game shall not be usable or playable to win prizes.

(d) In all events, the determination of eInstant prize winners shall be subject to the general ticket validation requirements set forth in K.A.R. 111-22-7 and the requirements set forth in the rules of each eInstant game.

(e) No particular prize may be paid more than once.

(f) All prizes must be claimed on or before an eInstant game ticket’s expiration date. Any prize not claimed by the expiration date shall be forfeited.

(g) The right of any person to a prize shall not be assignable, except that payment of any prize may be paid to the estate of a deceased prize winner or to a person designated pursuant to an appropriate judicial order. 111-22-7. Ticket validation requirements. (a) Each eInstant game ticket shall be validated prior to payment of a prize.

(b) In addition to meeting all other requirements in these rules and the specific rules for each eInstant game, the following validation requirements shall apply to all eInstant game tickets:

(1) The ticket must have been issued by the Kansas lottery in an authorized manner and must not be counterfeit in whole or in part.

(2) The ticket must not be altered or tampered with in any manner.

(3) The ticket must be identified and accepted by the Kansas lottery’s ticket validation system as a valid winning ticket.

(4) The serial number of an apparent winning ticket shall appear in the Kansas lottery’s official computer database of ticket validation numbers of winning tickets and a ticket with that ticket validation number shall not have been paid previously.

(5) The ticket must pass all additional confidential validation tests of the Kansas lottery.

(c) Any ticket not passing all of the validation checks stated in this section is void and ineligible for any prize. In the event that a defective ticket is purchased, the only responsibility or liability of the Kansas lottery shall be for reimbursement of the cost of the defective ticket.

(d) Subject to certain conditions, prize payment may be made for an eInstant game ticket that is not claimed by applicable deadlines. The following conditions may constitute exceptions to the validation requirements previously identified in paragraphs (a), (b) and (c):

(1) Consideration will only be given to claimants following an attempt to claim a prize prior to the ticket’s expiration.

(2) A record of the attempt must be contained within the Kansas lottery’s website or mobile application identifying the date and time of the validation attempt, the serial number of the ticket, and the prize amount.

(3) The claimant must complete the claim process within 5 days of the expiration date, be authorized to purchase an eInstant lottery game ticket, be eligible to claim the prize, and be the rightful recipient of the prize claimed as determined by the lottery.

(4) Lottery security will conduct an investigation to determine if the claim is or is not supported by the investigation and will submit a report with a recommendation to that effect to the executive director of the lottery.

(5) The final decision on whether a prize will be paid shall be made by the executive director. (Authorized by K.S.A. 2023 Supp. 74-8710; implementing K.S.A. 2023 Supp. 74-8710 and K.S.A. 74-8720; effective, T-111-8-9-24, July 10, 2024.)

111-22-8. Payment of prizes. The procedures for payment of monetary prizes to the winners of each eInstant game are as follows:

(a) The executive director or his designee shall award the designated prize to the person entitled to a prize pursuant to K.A.R. 111-22-6 as soon as it is determined that all laws, regulations, and rules have been adhered to.

(b) eInstant lottery game prizes of $599.00 or less shall be automatically paid to the winner’s wallet.

(c) eInstant lottery game prizes in excess of $599.00 shall be paid to the winner’s wallet after the winner has completed a claim form provided by the Kansas lottery. The winner shall be required to provide additional information including a complete social security number, bank account and routing numbers, or other information reasonably required to verify the winner’s identity and pay the prize if that information was not provided during account registration in the lottery’s player loyalty program defined in K.A.R. 111-18-1 et seq.

(d) All prizes are subject to deductions, withholding, and setoff provided by law. (Authorized by K.S.A. 2023 Supp. 74-8710; implementing K.S.A. 2023 Supp. 74-8710 and K.S.A. 74-8720; effective, T-111-8-9-24, July 10, 2024.)

111-22-9. Responsibility for account security. (a) The Kansas lottery is not responsible for lost or stolen accounts. The Kansas lottery is not responsible for any deposited funds or claimed or unclaimed prizes in any lost or stolen account.

(b) Players may be required to prove their identity to the satisfaction of the Kansas lottery prior to having their access to a lost or stolen account restored. (Authorized by K.S.A. 2023 Supp. 74-8710; implementing K.S.A. 2023 Supp. 74-8710 and K.S.A. 74-8720; effective, T-111-8-9-24, July 10, 2024.)

111-22-10. Disputes. In the event of a dispute between a ticket purchaser and the Kansas lottery concerning any eInstant game, the executive director shall determine the facts underlying the dispute and pay a prize to the purchaser of a valid winning ticket. If the investigation of the dispute is inconclusive, the executive director may, solely at his or her option, reimburse the ticket purchaser for the cost of the disputed ticket. If the investigation of the dispute determines facts in favor of the Kansas lottery, the executive director shall deny any claim relating to the dispute. 111-22-11. Termination of the game. At any time, the executive director may announce a termination date for an eInstant game, or announce a last date for sale of tickets in a game. The executive director may make any such announcement for any reason permitted by the Kansas lottery act, including but not limited to: protecting the integrity of the game subject to the announcement; compliance with any other law, rule and regulation, or other legal obligation; and the orderly operation of the lottery. 111-22-12. Payment of prizes to persons under 18 years of age. (a) In the event a person entitled to a prize for any winning ticket by means of a gift or inheritance is under 18 years of age, the lottery may require:

(1) The claim form for all prizes of $25 or more to be signed by the parent or legal guardian of the minor; and,

(2) Payment by delivery of a warrant, payable to the order of the minor, to a parent or legal guardian of the minor.

(b) Where the prize exceeds $5,000, payment shall be made for the benefit of the minor to the court appointed guardian or conservator, or as may otherwise be ordered by the court, upon receipt of written verification of the appointment of the legal guardian or conservator satisfactory to the executive director. 111-22-13. Invalidation of tickets. No eInstant game ticket shall be valid after its expiration date. (Authorized by and implementing K.S.A. 2023 Supp. 74-8710; effective, T-111-8-9-24, July 10, 2024.)

Article 23.—SPECIFIC eINSTANTS RULES

111-23-1. “Silver Fox Hunt” eInstant ticket lottery game. (a) The Kansas lottery may conduct an eInstant lottery game entitled “Silver Fox Hunt.” The rules for this game are contained in K.A.R. 111-22-1 et seq. and 111-23-1.

(b) The “play symbols” for this game are as follows:

(c) For this game, four play symbols and one prize symbol shall appear in each of the ticket play areas purchased by the player. There shall be six ticket areas. Each ticket area shall be dim or empty until the player purchases that ticket.

(d) Each pool shall consist of 10,000,000 tickets.

(e) The price of tickets for this game shall be $1.00, $2.00, and $5.00.

(f) “Silver Fox Hunt” is a multi-ticket symbol match game with a bonus play feature. The player may select between one and six tickets to play at the time of purchase. Each ticket shall be the same denomination. The player may purchase the selected number of tickets by pressing the “Play” icon. Each purchased ticket is presented in the form of a single line. The player may reveal the play and prize symbols by manually clicking on each play and prize symbol, or by clicking on the “Reveal All” icon. If the player matches three symbols on any ticket, the player wins the prize amount for that ticket. If the player matches four symbols on any ticket, the player wins the prize for each ticket they purchased in that game. If a player matches four “Bonus Envelope” symbols, the player will play a bonus game. In the bonus game, the player has three Agent Silver Fox characters. The player will click on each character, which will progress across the bonus play area. Each character may land on a prize amount or be impeded by a shadow and not land on a prize. The player will win the total cumulative amount attained by all of the characters in the bonus game. Each bonus game will have at least one character land on a prize.

(g) The total number of prizes and bonus prizes in any winning game may be variable but shall equal any prize described in paragraph (j).

(h) Approximately 30,000,000 tickets shall be ordered initially for this eInstant game. Additional ticket orders shall have the same prize structure, the same number of prizes per prize pool of 10,000,000 tickets, and the same odds as were contained in the initial ticket order.

(i) Each prize shall be calculated by multiplying the prize multiplier by the ticket cost:

111-23-2. “Bacon Me Crazy” eInstant ticket lottery game. (a) The Kansas lottery may conduct an eInstant lottery game entitled “Bacon Me Crazy.” The rules for this game are contained in K.A.R. 111-22-1 et seq. and 111-23-2.

(b) The “play symbols” for this game are as follows:

The player may reveal the play and prize symbols by manually clicking on each play spot, or by clicking on the “Reveal All” icon. A play spot may be blank once revealed. If the player reveals two “Coin” symbols and a “Pink Piggy Bank” symbol on any ticket, the player wins the prize amount shown on the “Pink Piggy Bank” symbol. If one of the revealed “Coin” symbols displays a multiplier, the prize amount for that ticket is multiplied by the multiplier amount. If the player reveals two “Coin” symbols and a “Gold Piggy Bonus Bank” symbol, the player may play a bonus game. If one of the “Coin” symbols displays a multiplier, it will be carried over into the bonus game. In the bonus game, the player will have three coins and six piggy banks separated by a pachinko-style area. The player will select a coin and it will traverse the bonus area to land in a piggy bank.
