Notice of Water Quality Certification
The Kansas Department of Health and Environment (KDHE) has drafted a water quality certification per Section 401 of the Clean Water Act (CWA) requested by Brian Lang PE, for Doyle Creek Watershed Joint District No. 86 for a Section 404 of the CWA #NWK-2008-01774, see https://www.nwk.usace.army.mil/Media/Public-Notices/. The project is a floodwater retarding structure to be built across an unnamed tributary to Doyle Creek. The embankment will be 27 feet tall and approximately 1,360 feet long. It will be constructed of compacted earthfill materials from the required excavation of the auxiliary spillway and from excavation in the sediment pool upstream of the embankment. The principal spillway will consist of a 24-inch reinforced concrete pipe with a 42-inch concrete pipe riser and other appurtenances. The principal spillway will outlet into a riprap lined stilling basin before entering the natural channel approximately 150 feet downstream of the centerline of the embankment.
The draft certification will be posted on the KDHE website at https://www.kdhe.ks.gov/1095/Section-401-Water-Quality-Certification on or before April 17, 2025. Persons wishing to comment on the referenced draft document must submit their comments in writing by email to the Kansas Department of Health and Environment at KDHE.NPS@ks.gov by May 17, 2025, if they wish to have their comments considered in the formulation of final determinations for 401 regarding this public notice.
