Notice of Hearing on Proposed Administrative Regulations

A public hearing will be conducted at 9:00 a.m. Tuesday, September 16, 2025, at the Kansas Commission on Peace Officers’ Standards & Training office (CPOST), 1999 N Amidon, Suite 350, Wichita, KS 67203, to review and consider the adoption of proposed permanent regulations of the Kansas Commission on Peace Officers’ Standards & Training. The public hearing will be conducted in person.

This 60-day notice of the public hearing shall constitute a public comment period for the purpose of receiving written public comments on the proposed regulations. All interested parties may submit written comments prior to the public hearing to Mike Brown, Executive Director, Kansas CPOST, 1999 N Amidon, Suite 350, Wichita, KS 67203 or by email to cpost.admin@ks.gov. All interested parties will be given a reasonable opportunity to present their views orally regarding the adoption of the proposed regulations during the public hearing. In order to provide all parties an opportunity to present their views, it may be necessary to request that each participant limit any oral presentation to five minutes.

Any individual with a disability may request an accommodation in order to participate in the public hearing and may request the regulations and economic impact statements in an accessible format. Handicapped parking is located at the main (east) entrance to the building. Curbs at the east entrance are accessible to individuals with disabilities and an elevator is directly west of the east main entrance.

Summaries of the proposed regulations and their economic impacts follow. (Note: Statements indicating that “The Commission anticipates that the proposed amendment/new regulation will have minor to no economic impact” are intended to indicate that no economic impact on the Board, other state agencies, persons subject to the proposed regulations, or the general public have been identified.)

K.A.R. 106-2-3. Unprofessional conduct. The proposed amendment to this regulation modifies the definition of unprofessional conduct to include the following additional acts or omissions: (m) failing to report a criminal offense to the commission as required by K.A.R. 106-2-2b, and amendments thereto; or (n) failing to comply with the requirements of K.S.A. 74-5611a(c), and amendments thereto, or K.S.A. 74-5611a(b), and amendments thereto, or both.

The Commission anticipates that the proposed amendments will have minor to no economic impact on the law enforcement community or the general public.

K.A.R. 106-3-7. Establishment of a Standard Qualification Course of Fire. The proposed creation of this regulation simply codifies a Standard Qualification Course of Fire that is required by K.S.A. 74-5607(e) into a K.A.R. Additionally, this course of fire has been voluntarily adhered to for the past 18+ years by Kansas law enforcement agencies. The Commission anticipates that the new regulation will have minor to no economic impact on the law enforcement community or the general public.
