Notice of Hearing
The Kansas Department of Health and Environment (KDHE) is proposing a revision to the State Implementation Plan (SIP). The SIP revision addresses section 169A of the Clean Air Act (CAA) with respect to regional haze and the regional haze rule, title 40 code of federal regulations (CFR) §51.308. This is the second of six ten-year plans required under the CAA and evaluates progress made in implementation measures included in the currently approved regional haze SIP.
The SIP revision will be submitted to the U.S. Environmental Protection Agency (EPA) for review and approval. Regional Haze is caused by air pollutant emissions which obscure important scenic vistas at Class I federal parks and wilderness areas. States are required to revisit regional haze SIPs every ten years and evaluate progress every five years. KDHE submitted a proposed regional haze SIP revision for the second planning period to EPA on July 28, 2021, which was later disapproved by the EPA August 7, 2024. KDHE then submitted a 5-year-progress report January 31, 2025. KDHE is resubmitting the July 28, 2021, regional haze SIP along with a supplement to address EPA’s concerns regarding the original submittal of the second volume of the regional haze SIP.
KDHE provided federal managers the opportunity for consultation and comment on the proposed revision on March 12, 2025, in accordance with title 40 CFR §51.308(i)(2). Their comments and KDHE’s responses are included in this proposed SIP revision.
Any member of the public may request a hearing or submit comments regarding this proposal. If requested, KDHE will hold a public hearing at 1:00 p.m. December 1, 2025, in the Curtis State Office Building, Flint Hills Conference Room (3rd Floor), 1000 SW Jackson, Topeka, Kansas. Comments from the interested public may be submitted to KDHE, Bureau of Air, Attn: Melissa McDonald, 1000 SW Jackson, Suite 310, Topeka, 66612-1366, by email to kdhe.boaregSIPcomments@ks.gov, or by fax to 785-559-4256. Public comments must be submitted no later than 5:00 p.m. December 1, 2025, to ensure consideration. Information on the status of the hearing, and details concerning the hearing format and timing will be posted on the KDHE Bureau of Air Planning Tab on the public notice website at https://www.kdhe.ks.gov/413/Public-Notices. If no request for a hearing is received on or before November 20, 2025, the scheduled hearing will be canceled and notice of the cancelation will be posted under the Planning tab of the KDHE Bureau of Air public notice website cited above prior to 5:00 p.m. November 25, 2025.
