Notice of Hearing on Proposed Administrative Regulations
A public hearing will be conducted at 11:00 a.m. Tuesday, February 10, 2026, in the Docking State Office Building Twister conference room, room 126, 915 SW Harrison St., Topeka, Kansas, to review and consider the adoption of proposed permanent fee regulations, K.A.R. 7-16-1; 7-16-2; 7-17-4; 7-34-2; 7-39-1; 7-49-1; 40-16-1; 40-16-2; 7-50-1; 7-51-1, of the Secretary of State. The hearing will be conducted in person. Additionally, interested parties wanting to participate remotely may contact Clay Barker at clay.barker2@ks.gov to obtain remote access information.
This 60-day notice of the public hearing shall constitute a public comment period for the purpose of receiving written public comments on the proposed regulations. Comments may be submitted prior to the hearing to Clay Barker, General Counsel, Office of the Secretary of State, Docking State Office Building, 915 SW Harrison St., Topeka, KS 66612, or to clay.barker2@ks.gov. All interested parties will be given a reasonable opportunity at the hearing to present their views. It may be necessary to request each participant to limit any oral presentation to five minutes.

Summaries of the proposed regulations and their economic impact follow.
The Kansas Secretary of State is entirely fee-funded, with no State General Fund appropriations supporting its operations. Every filing and service provided by the Secretary of State has an associated fee authorized by statute. Following the successful replacement of a 40-year-old IT infrastructure, the agency is implementing the first major overhaul of its fee structure in 15 years.
As a result, the proposed changes repeal dozens of outdated fees and reduce many other fees. Fees for forming new LLCs and LLPs, for PEO filings, and for biennial reports have been significantly lowered. Fees for paper filings — when e-filing is available — have been marginally increased to reflect increased labor processing costs and to encourage the use of e-filing.
These new, amended and revoked regulations impose no economic burdens on governmental agencies or units, persons subject to the proposed rules and regulations, and the general public as fees are already required and are generally being decreased.
Amended Regulations
- 7-16-1: Information and Services fee: Hundreds of fees are addressed in this amended regulation. Most are reduced; paper-filing fees are slightly higher; fees for outdated filings and services are eliminated; and a new fee is imposed on agencies that file regulations.
- 7-16-2: Technology Communication fee: Dozens of fees are addressed in this amended regulation. Most remain set at the statutory maximum of $5 per filing, and fees associated with outdated filings and services are eliminated.
- 7-17-4: Uniform Commercial Code: Fees for new bulk services have been added.
- 7-34-2: Corporations: Fees for unnecessary services and those provided automatically through the new IT system have been eliminated.
- 7-39-1: Limited Liability Partnerships (LLPs): Filing fee for forming an LLP is reduced from $150 to $75.
New Regulations
- 7-49-1: Professional Employer Organizations (PEOs): Filings fees were reduced from $1,000 and $500, to $250.
- 7-50-1: Limited Liability Companies (LLCs): Filing fee for forming an LLC is reduced from $150 to $75.
- 7-51-1: Limited Partnerships (LPs): Filing fee for forming an LP is reduced from $150 to $75.
Revoked Regulations
- 40-16-1; 40-16-2: Outdated PEO fee regulations issued by Commissioner of Insurance before PEO filings were moved to the Secretary of State.
