Notice of Proposed Kansas Air Quality Class II Operating Permit
Notice is hereby given that the Kansas Department of Health and Environment (KDHE) is soliciting comments regarding a proposed initial air quality operating permit. Neodesha Municipal Power Generation has applied for an initial Class II operating permit in accordance with the provisions of K.A.R. 28-19-540 et. seq. Emissions of volatile organic compounds (VOC) and oxides of nitrogen (NOX), were evaluated during the permit review process. The purpose of a Class II operating permit is to limit the potential-to-emit for these pollutants to below major source thresholds.
Neodesha Municipal Power Generation, 1407 N. 8th St., PO Box 336, Neodesha, KS 66757, owns and operates a fossil fuel electric power generation plant located at N. 4th St. and Tank Ave., Neodesha, KS 66757.
A copy of the proposed initial Class II operating permit, permit application, all supporting documentation, and all information relied upon during the permit application review process are available for public review during normal business hours of 8:00 a.m. to 5:00 p.m. at the KDHE, Bureau of Air (BOA), 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366, and at the KDHE Southeast District Office, 308 W. 14th St., Chanute, KS 66720. To obtain or review the proposed permit and supporting documentation, contact Emilee Agnew at the central office of KDHE at 785-296-1518, and to review the proposed permit only, contact Ryan Jack at the KDHE Southeast District Office at 620-431-2390. The standard departmental cost will be assessed for any copies requested. The proposed permit, accompanied with supporting information, is available, free of charge, at the KDHE BOA Public Notice website at https://www.kdhe.ks.gov/413/Public-Notices.
Please direct written comments or questions regarding the proposed permit to Emilee Agnew, KDHE, BOA, 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366. In order to be considered in formulating a final permit decision, written comments must be received no later than 12:00 p.m. April 6, 2026.
A person may request a public hearing be held on the proposed permit. The request for a public hearing shall be in writing and set forth the basis for the request. The written request must be submitted to Emilee Agnew, KDHE, BOA, 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366, no later than 12:00 p.m. April 6, 2026, in order for the Secretary of Health and Environment to consider the request.
