Article 46.—UNDERGROUND INJECTION CONTROL REGULATIONS
28-46-46. Underground Injection Control, fees. (a) Pursuant to K.A.R. 28-45-22 and K.A.R. 28-46-45, each permittee shall submit an annual permit fee based on the following type of Class 1 well:
- (1) Permitted, but undrilled, monitored, shut-in well $1,000
- (2) Permitted active injection non-hazardous well $3,500
- (3) Permitted active hazardous well $5,500
- (4) Permitted active injection non-hazardous well for facilities already subject to fees $1,750
- (5) Permitted active injection hazardous well for facilities already subject to fees $2,750
(b) Each permittee shall submit an annual permit fee based on the following type of Class V well:
- (1) Permitted, but undrilled, monitored, shut-in well $1,000
- (2) Permitted active injection well $1,500
- (3) Permitted aquifer recharge well $100
(c) Payment shall be made to the “Kansas department of health and environment – subsurface hydrocarbon storage fund” on or before April 1 of each year.
(d) The fees collected under this regulation shall be nonrefundable.
(e) If ownership of an underground injection control well changes prior to or on April 1 of a given year, no additional fee levied under this provision shall be required, provided the previous owner submitted the fees due on or before April 1.
