Article 46.—UNDERGROUND INJECTION CONTROL REGULATIONS

28-46-46. Underground Injection Control, fees. (a) Pursuant to K.A.R. 28-45-22 and K.A.R. 28-46-45, each permittee shall submit an annual permit fee based on the following type of Class 1 well:

  • (1) Permitted, but undrilled, monitored, shut-in well $1,000
  • (2) Permitted active injection non-hazardous well $3,500
  • (3) Permitted active hazardous well $5,500
  • (4) Permitted active injection non-hazardous well for facilities already subject to fees $1,750
  • (5) Permitted active injection hazardous well for facilities already subject to fees $2,750

(b) Each permittee shall submit an annual permit fee based on the following type of Class V well:

  • (1) Permitted, but undrilled, monitored, shut-in well $1,000
  • (2) Permitted active injection well $1,500
  • (3) Permitted aquifer recharge well $100

(c) Payment shall be made to the “Kansas department of health and environment – subsurface hydrocarbon storage fund” on or before April 1 of each year.

(d) The fees collected under this regulation shall be nonrefundable.

(e) If ownership of an underground injection control well changes prior to or on April 1 of a given year, no additional fee levied under this provision shall be required, provided the previous owner submitted the fees due on or before April 1. (Authorized by and implementing K.S.A. 2025 Supp. 55-1,117; effective April 17, 2026.)
