Notice of Water Quality Certification
The Kansas Department of Health and Environment has drafted a water quality certification per Section 401 of the Clean Water Act (CWA) requested by Wildhorse River Works, Inc., on behalf of Pottawatomie County Public Works under Section 404 of the CWA #NWK-2025-00067 at https://www.nwk.usace.army.mil/Media/Public-Notices.
The applicant proposes to rehabilitate a stream bank on site totaling 1,150 feet of the eroding right) descending streambank of Rock Creek in the SE¼ of section 27, T9S, R10E and the SW¼, Section 26, T9S, R10E in Pottawatomie County, Kansas. This project will require the placement of 3,793 tons of limestone rock to be placed in Rock Creek to reduce erosion along the streambank and protect the bridge. All disturbed areas will be seeded, mulched, and planted with native grasses, trees, and shrubs. It is estimated that 13 rock vanes and 715 feet of longitudinal peaked stone-toe protection (LPSTP) will be placed in the creek and along the edge of water. One rock cross-vane and one engineered rock riffle (ERR) will also be placed in the creek. The eroding riverbank will be regraded to a 2.6-foot horizontal to 1-foot vertical slope and planted with of native plant materials.
The draft certification will be posted on the KDHE website at https://www.kdhe.ks.gov/1095/Section-401-Water-Quality-Certification on or before February 13, 2025. Persons wishing to comment on the referenced draft document must submit their comments in writing by email to the Kansas Department of Health and Environment at KDHE.NPS@ks.gov by March 13, 2025, if they wish to have their comments considered in the formulation of final determinations for 401 regarding this public notice.
